1. Agreement to Terms

By creating a MobiWallet account or using our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

We reserve the right to update these terms at any time. We will notify you of significant changes via email or in-app notification. Your continued use of the service after changes are posted constitutes acceptance of those changes.

2. Account Registration

To use MobiWallet, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Complete identity verification when required

You are responsible for all activity that occurs under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.

3. Permitted Use

MobiWallet services may only be used for lawful purposes. You agree not to use our services to:

• Violate any local, state, national, or international law
• Send or receive funds related to illegal activities
• Engage in money laundering or terrorist financing
• Infringe on intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Impersonate another person or entity
• Engage in fraudulent or deceptive practices

4. Fees and Payments

MobiWallet charges fees for certain services as outlined in our pricing page. You agree to pay all applicable fees and authorize us to charge your payment method. Fees are subject to change with 30 days' notice.

Transaction limits apply based on your account type and verification level. We reserve the right to refuse or reverse transactions that violate our policies or applicable laws.

5. Privacy and Data Protection

We take your privacy seriously. Our Privacy Policy explains how we collect, use, and protect your personal information. By using MobiWallet, you consent to our data practices as described in the Privacy Policy.

We implement industry-standard security measures to protect your data, but no method of transmission over the internet is 100% secure. You acknowledge and accept the inherent security risks of providing information online.

6. Intellectual Property

All content, features, and functionality of MobiWallet, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of MobiWallet or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

7. Limitation of Liability

To the maximum extent permitted by law, MobiWallet and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services.

Our total liability for any claims arising from these terms or your use of our services shall not exceed the greater of $100 or the amount of fees you paid to us in the 12 months prior to the claim.

8. Dispute Resolution

Any dispute arising from these terms or your use of MobiWallet shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree to waive any right to a jury trial or to participate in a class action lawsuit. The arbitration shall be conducted in San Francisco, California, and judgment may be entered in any court of competent jurisdiction.

9. Account Termination

You may close your account at any time by following the process in the app. We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or for any other reason at our sole discretion.

Upon termination, you must withdraw all funds from your account within 30 days. After this period, we may return funds to the source or hold them in accordance with applicable escheatment laws.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of courts located in San Francisco, California for any legal proceedings.
